By requesting a Psychic/Medium reading/energy healing, or by scheduling an appointment with April Tinsley, or April Tinsley Spiritual Services, you understand and agree that April Tinsley is not a medical, psychological, financial or legal counselor, and that the services offered are based on April Tinsley’s Spiritual Services and April’s personal intuitive abilities and offered by her through (her Website or “Company”). By continuing on with receiving psychic intuitions, psychic readings or any other spiritual guidance offered on the Website, you (“the User”) hereby acknowledge and agree to release the Company from any and all liabilities that may arise from using the Website and its services. By using the Website, the User agrees to be bound by the terms of this Release of Liability.
TERMS AND CONDITIONS
1. Acknowledgment of Spiritual and Entertainment Purposes:
The User acknowledges that the psychic intuitions, psychic readings, and any other spiritual guidance provided on the Website are for entertainment and spiritual purposes only. The Company does not guarantee the accuracy, completeness, or effectiveness of the readings and expressly disclaims any responsibility or liability for any decisions or actions the User may take based on the information received through the Website.
2. No Professional Advice or Medical Information:
The User acknowledges and understands that the psychic readings and other spiritual guidance offered on the Website are not intended to replace professional advice, medical, psychological, financial, or legal counseling. The User is encouraged to seek appropriate advice from qualified professionals for any such matters.
3. Voluntary Participation and Assumption of Risk:
The User voluntarily chooses to participate in psychic readings and other spiritual guidance offered on the Website and assumes all risks associated with such participation. The User acknowledges that psychic readings are subject to interpretation and personal beliefs, and the Company cannot be held responsible for the User’s interpretation or actions.
4. Limitation of Liability:
The User agrees that the Company, its affiliates, employees, agents, and representatives shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of the Website or the information provided therein. This includes but is not limited to, damages for loss of profits, data, goodwill, or other intangible losses.
5. Indemnification:
The User agrees to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, and representatives from any and all claims, liabilities, damages, and expenses (including attorney fees) arising out of or related to the User’s use of the Website or any breach of this Release of Liability.
6. Age Limitation:
The User must be at least 18 years of age to access and use the Website. By accessing and using the Website, the User represents and warrants that they are at least 18 years old.
7. Entire Agreement:
This Release of Liability constitutes the entire agreement between the User and the Company concerning the subject matter herein and supersedes all prior or contemporaneous agreements, whether written or oral. “FOR ALL SERVICES/PRODUCTS: By purchasing a service you agree that each is for personal reflection purposes only. You also agree that you will not share, sell, resell, reproduce, duplicate, copy or exploit any information I provide to you as part of the services or any information you have access to as part of the services. All intellectual property contained therein is protected by valid trademarks or copyrights, where applicable. This will be enforced by April Tinsley’s Legal Representation. Breach of this Agreement will subject the Breaching Party to attorney’s fees, court fees, and other reasonable legal costs; Venue for any litigation will occur in Merced County, California.
8. No Refunds:
The timing, accuracy, understanding and reception of the information by the User is not known and therefore, the actualization/failure to actualize any of the information or guidance offered is not a basis for a refund, claim for credit, or dispute. Any claims for refunds or disputes may be treated as a violation of this agreement, subjecting the User to costs associated with collecting, administering payments or resolving disputes. Any costs will be treated as described in paragraph number 7 above.
By accessing and using April Tinsley’s intuitive abilities, the User acknowledges that they have read and understood this Release of Liability and agree to be bound by its terms.
